These Terms and Conditions ("Terms") govern your access to and use of the Duck Passport website, mobile application, and related services (collectively, the "Services"). In these Terms, "Duck Passport," "we," "us," and "our" refer to the operator of the Services.

By accessing or using the Services, creating an account, or continuing as a guest, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. The Services

Duck Passport is a community platform for registering and tracking cruise ducks, recording duck hides and finds, viewing duck travel journals, organizing cruise itineraries, creating printable duck tags, receiving account and activity notifications, reporting content, and contacting support. Some features require an account, while others may be available to guests.

Duck Passport is not a cruise line, travel agency, ship operator, safety authority, or owner of the physical ducks tracked through the Services. Information supplied by users or third parties, including itinerary, ship, location, and duck-history information, may be incomplete, delayed, or inaccurate. You are responsible for confirming important information with the applicable cruise line or other authoritative source.

2. Eligibility and accounts

You must be at least 18 years old to create and independently manage an account. A person under 18 may use the Services only with the involvement and permission of a parent or legal guardian who accepts responsibility for that use. The Services are not directed to children under 13.

You must provide accurate account information, keep it current, safeguard your sign-in credentials and one-time codes, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account. A primary account holder is also responsible for sub-accounts created or managed through that primary account and for assigning appropriate permissions and trip access.

You may not sell, transfer, impersonate, or share an account in a way that compromises its security or misrepresents the person using it.

3. Acceptable use

You agree not to use the Services to:

  • violate any law, regulation, cruise-line policy, ship rule, or third-party right;
  • harass, threaten, exploit, deceive, impersonate, or invade the privacy of another person;
  • post unlawful, hateful, sexually explicit, dangerous, fraudulent, or intentionally misleading content;
  • upload malware or interfere with the security, integrity, availability, or operation of the Services;
  • probe, bypass, or defeat access controls, moderation systems, rate limits, or account restrictions;
  • scrape, copy, reverse engineer, or automatically access the Services except as permitted by law or with our written permission;
  • misuse tracking IDs, QR codes, support requests, content reports, or notification features;
  • collect or publish another person's personal information without lawful authority and appropriate consent; or
  • use the Services for unsolicited advertising, spam, or commercial activity that we have not authorized.

4. User content and permissions

"User Content" includes duck names and descriptions, photos, journal notes, hide and find details, tag designs, profile information, support messages, reports, and other material you submit through the Services. You retain ownership of your User Content.

You grant Duck Passport a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, adapt for technical purposes, display, and distribute your User Content as reasonably necessary to operate, secure, improve, and provide the Services. This license also allows us to make content available to other users when the feature you selected is intended to be public or shared. The license ends when the content is deleted from our active systems, except where continued retention is reasonably necessary for backups, security, legal compliance, dispute resolution, or content that other users have independently shared or incorporated into their activity.

You represent that you have the rights and permissions needed to submit your User Content and allow us to use it as described in these Terms. Do not upload confidential information, personal information about another person without permission, or content that infringes copyright, trademark, privacy, publicity, or other rights.

5. Moderation and reports

We may use automated tools and human review to assess uploaded images and other User Content. We may reject, remove, restrict, retain for investigation, or limit access to content or accounts that we reasonably believe violate these Terms, create risk, or interfere with the community. We are not required to pre-screen every submission and cannot guarantee that all objectionable or inaccurate content will be identified.

You may report content or contact support through the available reporting and support tools. Reports must be made in good faith. To protect privacy and platform integrity, we may not disclose enforcement actions, other reports, internal discussions, or information about another user's account. Support and reporting tools are not emergency services.

6. Cruise-line rules and physical safety

You are solely responsible for determining whether and where a physical duck may be hidden, moved, or handled. Always follow instructions from cruise-line personnel and all ship, port, venue, customs, security, sanitation, accessibility, and safety rules. Do not place a duck in a prohibited, restricted, hazardous, unsanitary, obstructive, or emergency-related area, or anywhere it could reasonably be mistaken for a dangerous or abandoned item.

YOU VOLUNTARILY ASSUME ALL RISKS ARISING FROM OR RELATED TO PHYSICAL DUCK ACTIVITIES, INCLUDING PLACEMENT, HIDING, FINDING, MOVING, HANDLING, TRAVEL, LOSS, DAMAGE, CONFISCATION, DISPOSAL, PERSONAL INJURY, PROPERTY DAMAGE, AND INTERACTIONS OR DISPUTES WITH OTHER PEOPLE. DUCK PASSPORT DOES NOT GUARANTEE THAT A PHYSICAL DUCK WILL BE FOUND, REMAIN IN A PARTICULAR LOCATION, BE RETURNED, OR CONTINUE ITS JOURNEY AND, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ACCEPTS NO LIABILITY WHATSOEVER FOR PHYSICAL DUCK ACTIVITIES OR THEIR CONSEQUENCES. THIS DOES NOT EXCLUDE ANY LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.

7. Duck Passport intellectual property

The Services and their software, visual design, text, logos, artwork, features, and other materials supplied by Duck Passport are owned by or licensed to Duck Passport and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended personal and community purposes.

You may not use Duck Passport branding in a way that suggests sponsorship or endorsement, remove proprietary notices, or reproduce or distribute substantial parts of the Services without our written permission, except where applicable law expressly permits it.

8. Third parties and non-affiliation

The Services may display or link to information, products, websites, app stores, analytics, authentication providers, cruise-line resources, or other services supplied by third parties. We do not control, endorse, or assume responsibility for those third parties or their content, products, services, acts, omissions, availability, accuracy, security, policies, or practices. Your access to and use of third-party services, and any dealings or disputes with third parties, are solely at your own risk and are governed by their own terms and policies. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DUCK PASSPORT ACCEPTS NO LIABILITY WHATSOEVER ARISING FROM OR RELATED TO ANY THIRD PARTY OR THIRD-PARTY PRODUCT, SERVICE, CONTENT, INFORMATION, ACT, OR OMISSION. THIS DOES NOT EXCLUDE ANY LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.

This web site is not endorsed by, directly affiliated with, maintained, authorized, or sponsored by any cruise line or third party. All product and company names are the registered trademarks of their original owners. The use of any trade name or trademark is for identification and reference purposes only and does not imply any association with the trademark holder of their product brand.

9. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Services, you acknowledge the practices described in that policy. Device settings and account preferences may allow you to control certain communications, including push notifications.

10. Service availability and changes

We may add, remove, suspend, limit, or change features, content, eligibility requirements, or technical access at any time. The Services may occasionally be unavailable because of maintenance, failures, security events, third-party outages, or circumstances outside our control. We do not promise that any feature, itinerary record, duck history, uploaded file, or account data will always remain available.

You are responsible for keeping copies of User Content or generated materials that you need. We may impose reasonable limits on storage, uploads, support access, or use to protect the Services and other users.

11. Suspension and termination

You may stop using the Services at any time and may request account deletion through your account settings or Support. We may suspend, restrict, or terminate access when reasonably necessary to enforce these Terms, protect users or the Services, comply with law, investigate misuse, or address security concerns.

Following termination, provisions that by their nature should survive will remain in effect, including provisions concerning intellectual property, retained records, disclaimers, limitations of liability, indemnification, and disputes.

12. Disclaimers and assumption of risk

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL CONTENT, INFORMATION, FEATURES, SOFTWARE, TOOLS, MATERIALS, AND RESULTS PROVIDED BY OR THROUGH THE SERVICES ARE PROVIDED STRICTLY "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." YOUR ACCESS TO AND USE OF THE SERVICES ARE ENTIRELY AT YOUR OWN RISK. DUCK PASSPORT MAKES NO REPRESENTATIONS, GUARANTEES, CONDITIONS, OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, AND DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

WITHOUT LIMITING THE FOREGOING, DUCK PASSPORT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, AVAILABLE, SECURE, ACCURATE, COMPLETE, SAFE, OR ERROR-FREE; THAT DEFECTS WILL BE IDENTIFIED OR CORRECTED; THAT DATA OR USER CONTENT WILL BE PRESERVED; OR THAT ANY DUCK, TRIP, SHIP, LOCATION, USER, USER CONTENT, NOTIFICATION, TAG, THIRD PARTY, OR THIRD-PARTY PRODUCT OR SERVICE WILL BE ACCURATE, SAFE, LAWFUL, RELIABLE, OR MEET YOUR EXPECTATIONS. YOU ARE SOLELY RESPONSIBLE FOR EVALUATING AND ASSUMING ALL RISKS ASSOCIATED WITH THE SERVICES AND FOR ANY DECISIONS, ACTIONS, LOSSES, OR CONSEQUENCES RESULTING FROM THEIR USE OR UNAVAILABILITY.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, CONDITIONS, OR CONSUMER RIGHTS. NOTHING IN THESE TERMS EXCLUDES, RESTRICTS, OR MODIFIES ANY WARRANTY, CONDITION, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED, RESTRICTED, OR MODIFIED. IN THOSE JURISDICTIONS, THE DISCLAIMERS IN THIS SECTION APPLY ONLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DUCK PASSPORT AND ITS OPERATORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND REPRESENTATIVES ACCEPT NO LIABILITY WHATSOEVER AND WILL NOT BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY CLAIM, LOSS, DAMAGE, INJURY, COST, EXPENSE, OR LIABILITY OF ANY KIND ARISING FROM OR RELATED TO THE SERVICES, THESE TERMS, OR YOUR ACCESS TO, USE OF, RELIANCE ON, OR INABILITY TO USE THE SERVICES.

THIS EXCLUSION APPLIES TO ALL DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, AND OTHER DAMAGES, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, LOST OR CORRUPTED DATA, LOST PROFITS, LOST REVENUE, LOST GOODWILL, LOST USE, AND LOST OPPORTUNITIES, REGARDLESS OF THE FORM OR THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR OTHERWISE, EVEN IF DUCK PASSPORT WAS ADVISED OF THE POSSIBILITY OF THE LOSS OR DAMAGE AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. IF APPLICABLE LAW REQUIRES DUCK PASSPORT TO HAVE LIABILITY THAT CANNOT BE EXCLUDED BUT PERMITS THAT LIABILITY TO BE LIMITED, DUCK PASSPORT'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS WILL BE LIMITED TO THE MINIMUM EXTENT AND MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW. YOU MAY HAVE RIGHTS OR REMEDIES UNDER APPLICABLE LAW THAT THESE TERMS CANNOT WAIVE.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Duck Passport and its operators, affiliates, licensors, service providers, and representatives from claims, liabilities, damages, losses, and reasonable costs arising from your User Content, your unlawful or unsafe conduct, your misuse of the Services, or your material violation of these Terms or another person's rights.

15. Governing law and disputes

These Terms and disputes arising from them or the Services are governed by the laws of the State of Indiana and applicable United States federal law, without regard to conflict-of-law rules. Unless applicable law requires otherwise, the state and federal courts located in Indiana will have exclusive jurisdiction, and you consent to their personal jurisdiction.

Before filing a claim, you and Duck Passport agree to make a good-faith effort to resolve the dispute informally by contacting the other party and allowing a reasonable opportunity to respond. Nothing in this section prevents either party from seeking urgent injunctive relief or using a qualifying small-claims procedure.

16. Changes to these Terms

We may update these Terms from time to time. The effective date at the top will identify the latest version. If a change is material, we may provide additional notice through the Services, by email, or by another reasonable method. Your continued use after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

17. General terms

These Terms and the Privacy Policy form the entire agreement between you and Duck Passport concerning the Services unless a separate written agreement applies. If any provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, sale, or transfer of the Services. Headings are for convenience only.
